1. Agreement to Terms
By accessing or using Axeinos ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
Axeinos is a hosting reseller platform that enables you to manage multiple hosting providers, automate billing, and provide a unified client portal. We act as an intermediary between you and upstream hosting providers.
Axeinos does not directly provide hosting services but facilitates the resale of hosting services from third-party providers. You are responsible for your relationships with upstream providers and your end customers.
3. Account Registration
To use the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Transmit harmful, offensive, or illegal content
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use automated systems to access the Service without permission
- Resell or redistribute the Service without authorization
5. Billing and Payments
Subscription fees are billed in advance on a monthly or annual basis. You agree to pay all fees associated with your account. Fees are non-refundable except as required by law or as explicitly stated in your plan.
We reserve the right to change our pricing with 30 days' notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.
If payment fails, we may suspend or terminate your account. You remain responsible for all charges incurred prior to termination.
6. Third-Party Providers
Axeinos integrates with third-party hosting providers. We are not responsible for:
- The availability, performance, or reliability of third-party services
- Terms of service or privacy policies of third-party providers
- Disputes between you and upstream providers
- Data loss or service interruptions caused by third-party providers
You are responsible for reviewing and accepting the terms of each provider you connect through Axeinos.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. We process data necessary to provide the Service, including account information, usage data, and integration data with upstream providers.
You are responsible for ensuring that any data you process through Axeinos complies with applicable data protection laws, including GDPR, CCPA, and other regional regulations.
8. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Axeinos and protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of your data and content. By using the Service, you grant Axeinos a license to use, store, and process your data solely for the purpose of providing the Service.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
10. Limitation of Liability
To the maximum extent permitted by law, Axeinos shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Service.
Our total liability for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Axeinos, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any disputes between you and your customers or upstream providers
12. Termination
You may terminate your account at any time. We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent or illegal activity.
Upon termination, your right to use the Service will cease immediately. We may delete your account data after a reasonable retention period, except where we are required to retain it by law.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.
